Meat Society Subscription Terms and Conditions
General

These terms and conditions (“Subscription Terms”) govern your purchase and use of a paid Subscription service (“Subscription”) providing you access to certain benefits and/or discounts on the Meat Society website www.meatsociety.com.au (the “Website”).

The Subscription is provided to you by Hamster Tera Pty Ltd (ABN 63 687 451 574) C/- Meat Society, Shop A.01/122 Terry Street, Rozelle NSW 2039 (“Meat Society”, “we” or “our”). Purchase of a Subscription is deemed acceptance of these Subscription Terms and any additional terms applicable to Subscribers such as the Competition Terms and Conditions available to view https://meatsociety.com.au/policies/competition-terms (“Competition Terms”), the Meat Society Privacy Policy available to view here: https://meatsociety.com.au/policies/privacy-policy (“Privacy Policy”) and any other term specified in a Subscription offer from Meat Society, as stated at the time you subscribe (“Offer”) (together, the “Terms”, all incorporated into these Subscription Terms). If you do not agree to the Terms, you should not purchase a Subscription.

Except for persons residing in South Australia and the Australian Capital Territory (ACT) who are not eligible to purchase a Subscription, Subscription is open to all other Australian residents, aged 18 years and older (Subscriber).
Subscription Benefits

Your Subscription entitles you to certain benefits for the duration of your Subscription (“Subscription Benefits”). The details for your Subscription Benefits (and any applicable exclusions) will be set out in: (a) the Offer; (b) an email from Meat Society or (c) these Subscription Terms. Meat Society may choose to offer more than one type of Subscription. Subscription Benefits may differ based on the type of Subscription you have purchased. Subscription Benefits cannot be combined with other third-party promotional offers.

Subscription Benefits may include giveaways, competition entries subject to regulatory permits, access to exclusive content, discounts and other benefits in relation to goods or services purchased through the Website, as well as other benefits offered by third parties in connection with your Subscription from time to time. You may also receive additional access, discounts, giveaways or other benefits that are personalised for you, from time to time. When you purchase a Subscription, you agree to pay Meat Society a recurring monthly payment (“Recurring Payment”). The duration of your entitlement to the Subscription Benefits will align with the Recurring Payment billing interval (“Billing Cycle”). Your entitlement to the Subscription Benefits will automatically renew at the end of your Billing Cycle unless you cancel your Subscription.
Billing, Cancellation and Pause of Subscription

The Recurring Payment is in Australian Dollars and inclusive of GST and applicable taxes where required by law. You authorise Meat Society to charge the Recurring Payment for your first Billing Cycle to your nominated payment method on Your Billing Day, which will activate your Subscription. Your Billing Cycle commences on your scheduled billing date (“Your Billing Day”) and expires at midnight on the day prior to Your Billing Day in the subsequent calendar month. You further authorise Meat Society to automatically charge the Recurring Payment to your nominated payment method for each subsequent Billing Cycle, unless you cancel your Subscription.

For offers tied to your payment card, that card must still be valid and on your account when the relevant offer starts. For cancellations and to avoid charges cancel in the Subscriber section of the Website, by selecting Cancel Subscription at least 48 hours prior to Your Billing Day. If you cancel your Subscription, you will still have access to the Subscription Benefits until the end of your current Billing Cycle.

You can pause your Subscription at least 48 hours prior to your Billing Cycle to avoid being charged for the next Billing Cycle. During a pause, you will not be charged the Recurring Payment and you will not have access to the Subscription Benefits.

If your selected payment method is declined, Meat Society or its affiliate payment provider will prompt you for a new payment method. Meat Society may also automatically retry your selected payment method periodically over the course of Your Billing Cycle to help you get back to enjoying the benefits of your Subscription. However, Meat Society reserves the right to terminate your Subscription for any unpaid Billing Cycles with no further charges to you and you will not be eligible for any Subscription Benefits.

Subject to your rights under applicable law, including Australian Consumer Law, and any other term in these Subscription Terms, Recurring Payments are non-refundable.

Meat Society or its affiliates are not responsible for any fees charged by the payment provider (for example, the bank you have a payment card with) including, but not limited to, overdraft fees, insufficient funds fees, interest charges, foreign exchange fees, cross border fees, or other fees levied by the provider of your payment method.
Competitions

All competitions will be drawn pursuant to Competition Terms. Refer to the Competition Terms for any exclusions.
Changes to Subscriptions and Benefits

Meat Society may vary the Recurring Payment charged to your selected payment method from time to time. If your Recurring Payment increases we will provide you with 30 days prior notice via email before such increase takes effect. All changes will be effective after expiry of the 30 day notice period, upon the commencement of your next Billing Cycle. You may avoid these changes by cancelling your Subscription.

Meat Society may vary these Subscription Terms or the Subscription Benefits from time to time. Meat Society will provide you with at least 30 days’ written notice in the event of a material change to these Subscription Terms or the Subscription Benefits that detrimentally affects your rights under these Subscription Terms. Amendments will be effective upon posting of such updated Subscription Terms at www.meatsociety.com.au or such date specified in a written notice to you. Your continued use of your Subscription after expiry of the 30 days constitutes your consent to be bound by the amended Subscription Terms or Subscription Benefits.

If you do not agree to the revisions you may cancel your Subscription at any time during the 30 day notice period.
Meat Society’s Right to Suspend or Terminate Your Subscription

Meat Society may suspend or terminate your Subscription, in whole or in part, immediately, without notice, in circumstances where Meat Society reasonably suspects that:

you have, or are likely to, breach these Subscription Terms, the Competition Terms which are incorporated into these Subscription Terms and/or any applicable law; or
-
you have engaged in fraudulent activity in relation to, or otherwise misused, your Subscription.

Meat Society may terminate these Subscription Terms with respect to you, cancel your Subscription, or generally cease offering the Subscription (in whole or in part) on 30 days’ written notice to you where Meat Society, acting reasonably, terminates these Subscription Terms for any legitimate business reason or immediately for any legal or regulatory reason.

If Meat Society terminates these Subscription Terms or generally ceases to offer the Subscription, Meat Society will process a pro-rated refund to you based on charges already applied to your selected payment method for the current Billing Cycle. If that happens, you will have access to your Subscription Benefits until the date of termination but your Subscription will not auto-renew and you will not be charged for subsequent Billing Cycles. Subject to the Australian Consumer Law, Meat Society will not process any refund if these Subscription Terms are terminated pursuant to clause 17 (i) and (ii).
Disclaimers and Liability

To the extent permitted by applicable law, Meat Society, its directors, officers, employees and agents will not be responsible or liable to you or anyone else under or in connection with these Subscription Terms for any goods or services provided to you by a third party in connection with these Subscription Terms, including without limitation, liability for any personal injury, death or property damage after using or consuming goods or services provided by a third party obtained as part of the Subscription Benefits (Third Party Liability).

You hereby indemnify and hold harmless Meat Society, its directors, officers, employees and agents (Indemnified Parties) against any loss suffered or incurred, or any claim made against an Indemnified Party for Third Party Liability.

If you are acquiring your Subscription as a consumer, Meat Society's liability for a failure to comply with a consumer guarantee in the case of services supplied to you by Meat Society under these Subscription Terms is limited to the supply of the relevant services again or the payment of the cost of resupplying the services.

To the extent permitted by applicable law, in no event shall Meat Society, its directors, officers, employees and agents’ total combined liability to you in connection with your purchase or use of your Subscription for all damages, losses and causes of action (whether in contract, in tort (including negligence), in equity, by operation of law or otherwise) exceed the greater of: (a) one hundred Australian dollars (AUD $100); and (b) the value of the Recurring Payment(s) paid by you in respect of the Billing Cycle(s) in which the damage, loss or cause of action arose.

Meat Society’s and its directors, officers, employees and agents’ liability to you for a breach of any condition, warranty or term of these Subscription Terms that is not a breach of a consumer guarantee is also limited in the following way: Meat Society and its directors, officers, employees and agents shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost savings, lost data, death, personal injury or property damage related to, in connection with, or otherwise resulting from any use of the Subscription, even if Meat Society or its directors, officers, employees and agents have been advised of the possibility of such damages.

Meat Society shall not be liable for: (i) delay or failure in performance resulting from causes beyond Meat Society's reasonable control.
Privacy

Our collection and use of personal information in connection with your Subscription is as provided in Privacy Policy located at Privacy policy – Meat Society. The Privacy Officer can be contacted at lucky@meatsociety.com.au.
General

We may give notice by means of a general notice on the Website or via email to the address in your Account. You may give notice to Meat Society by written communication to Meat Society’s address at lucky@meatsociety.com.au.

You may not assign or transfer these Subscription Terms in whole or in part without Meat Society’s prior written approval. You give your approval to Meat Society for it to assign or transfer these Subscription Terms in whole or in part, including to: (i) a subsidiary or affiliate; (ii) an acquirer of Meat Society or its business or assets; or (iii) a successor by merger.

If any provision of these Subscription Terms is void, voidable, unenforceable, unlawful, prohibited or otherwise invalid it shall be severed from the Subscription Terms. That will not invalidate the remaining provisions of the Subscription Terms.

These Subscription Terms constitute the entire agreement of the parties in respect of the subject matter and supersedes all prior discussions, undertakings and agreements. Nothing in these Subscription Terms limits your rights as a consumer that cannot be excluded under applicable law, including the Australian Consumer Law. In these Subscription Terms, the words “including” and “include” mean “including, but not limited to”.

These Subscription Terms are exclusively governed by the laws of New South Wales, Australia. The parties irrevocably submit to the non-exclusive jurisdiction of the courts exercising jurisdiction there.
